The district court felt it had the discretion to depart downward from the sentencing guidelines, but chose not to. Thus, we do not have jurisdiction over Collins's appeal. See United States v. Morales, No. 89-10168, slip op. 2423, 2429-30 & n. 2 (9th Cir. March 5, 1990).
