Neil Graham Hansen, Petitioner-appellant, v. State of South Carolina; J.d. Swinson, Warden, Respondents-appellees, 891 F.2d 286 (4th Cir. 1989)

Annotate this Case
U.S. Court of Appeals for the Fourth Circuit - 891 F.2d 286 (4th Cir. 1989)

Submitted: Sept. 21, 1989. Decided: Nov. 13, 1989

Neil Graham Hansen, appellant pro se.

Donald John Zelenka (Office of the Attorney General of South Carolina), for appellees.

Before PHILLIPS, MURNAGHAN and WILKINS, Circuit Judges.

PER CURIAM:

Neil Graham Hansen seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254. Our review of the record and the district court's opinion accepting the recommendation of the magistrate discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court. Hansen v. State of South Carolina, C/A No. 89-22-3 (D.S.C. Aug. 10, 1989). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

DISMISSED.
