ORDER** 

We affirm the district court's order denying Singleton's 28 U.S.C. Section 2254 habeas petition for failure to exhaust state remedies. After the district court entered its order denying habeas relief, the California Court of Appeals affirmed Singleton's conviction. If this subsequent event has resulted in an exhaustion of state remedies, Singleton may file a new Section 2254 habeas petition in district court.

AFFIRMED.
