ORDER

This appeal has been referred to a panel of the court pursuant to Rule 9(a), Rules of the Sixth Circuit.

A review of the record indicates that the defendant, Joe Fowler, filed on August 26, 1988, in the district court a motion to dismiss the 42 U.S.C. § 1983 prisoner civil rights complaint. The plaintiffs filed a notice of appeal on August 30, 1988, from the motion to dismiss.

This court lacks jurisdiction to review a motion filed in the district court. No final decision has been entered in the case nor has an order been certified for interlocutory appeal under 28 U.S.C. § 1292(b) or Fed. R. Civ. P. 54(b). Donovan v.
