IN THE SUPREME COURT OF THE STATE OF DELAWARE DONALD BASS, Defendant BelowAppellant, v. STATE OF DELAWARE, Plaintiff BelowAppellee. § § § § § § § § § § § No. 92, 2004 Court Below Superior Court of the State of Delaware, in and for New Castle County Cr. ID 9607012102 Submitted: May 14, 2004 Decided: July 1, 2004 Before STEELE, Chief Justice, HOLLAND, and JACOBS, Justices. ORDER This 1st day of July 2004, after careful consideration of the opening brief and the motion to affirm, we find it manifest that the judgment of the Superior Court should be affirmed on the basis of the Superior Court=s well-reasoned decision dated February 27, 2004. The Superior Court did not err in concluding that Bass second motion for postconviction relief was both time-barred and repetitive and that Bass had failed to overcome these procedural hurdles. NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED. BY THE COURT: /s/ Myron T. Steele Chief Justice
