IN THE SUPREME COURT OF THE STATE OF DELAWARE IN THE MATTER OF THE PETITION OF MICHAEL D. JOHNSON FOR A WRIT OF MANDAMUS. No. 7, 2000 Submitted: March 20, 2000 Decided: April 5, 2000 Before VEASEY, Chief Justice, WALSH and BERGER, Justices. ORDER This 4th day of April 2000, it appears to the Court that: (1) On January 5, 2000, the petitioner, Michael D. Johnson ( Johnson ), filed a petition for a writ of mandamus asking that this Court issue an Order compelling the Superior Court to rule on Johnson s pending motion for postconviction relief. On January 14, 2000, the State filed an answer and motion to dismiss. (2) By letter dated February 28, 2000, the Assistant Clerk of this Court asked the Superior Court to inform the Court of the status of Johnson s postconviction motion. On March 20, 2000, the Superior Court filed a copy of its order of March 17, 2000, denying Johnson s motion for postconviction relief. The Superior Court s March 17 denial of Johnson s motion for postconviction relief renders moot Johnson s petition for a writ of mandamus in this Court. NOW, THEREFORE, IT IS HEREBY ORDERED that Johnson s petition for a writ of mandamus is DISMISSED as moot. BY THE COURT: /s/ E. Norman Veasey Chief Justice -2-
