STATE OF DELAWARE, Plaintiff Below, Appellee. § § § § No. 619, 1999 § § Court Below: Superior Court § of the State of Delaware in and § for New Castle County § Cr.A. No. IN97-09-1819 § § Submitted: October 17, 2000 Decided: October 20, 2000 Before WALSH, BERGER, and STEELE, Justices. ORDER This 20th day of October 2000, upon consideration of the briefs of the parties, we conclude that the Superior Court s ruling, which resulted in excusal of a juror because of the juror s discomfort with participating in the case due to the juror s knowledge of a State witness, was a discretionary ruling within the authority of the trial judge to manage the trial. We find no abuse of discretion and accordingly affirm. NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court be, and the same hereby is, AFFIRMED. BY THE COURT: s/Joseph T. Walsh Justice
