SUPERIOR COURT OF THE STATE OF DELAWARE T. HENLEY GRAVES SUSSEX COU NTY C OUR THO USE RESIDENT JUDGE ONE THE CIRCLE, SUITE 2 GEORGETOWN, DE 19947 July 22, 2010 Richard Lyle, Esquire Assistant Public Defender 14 The Circle, 2nd Floor Georgetown, DE 19947 RE: State v. Justin Wilson - Defendant ID No. 0911019557 Dear Mr. Lyle: The Court has studied your timely Motion for Modification of Sentence as well as the Court s file. I do appreciate your zealous advocacy for this young man. I can also appreciate your concern and frustration at having negotiated a favorable recommendation, and then have me come along and wreck the train. It is rare that the Court takes such drastic action. Mr. Wilson faced up to 38 years in jail. In light of his pattern of violent conduct and an apparent like of firearms, it was my opinion that community safety dictated he remain off the streets for a long time. The sentence as entered shall not be modified for the reasons stated at sentencing. The defense Motion for Modification of Sentence is denied. IT IS SO ORDERED. Yours very truly, T. Henley Graves THG:baj cc: Prothonotary Department of Justice
