SUPERIOR COURT OF THE STATE OF DELAWARE T. HENLEY GRAVES SUSSEX COUNTY C OURTHO USE RESIDENT JUDGE ONE THE CIRCLE, SUITE 2 GEORGETOWN, DE 19947 August 21, 2006 Bruce A. Rogers, Esquire 16 South Front Street Georgetown, DE 19947 RE: James W. Adkins, Esquire Department of Justice 114 East Market Street Georgetown, DE 19947 Petition for Expungement of Criminal Record Carol Murray - C. A. No. 06X-02-021 THG Dear Counsel: I have waited until after the legislative session to see whether or not certain proposed legislation would be acted upon by the House and the Senate. When the June 30th clock ran out, it was still being massaged and therefore nothing new is on the books this year. As to the present petition, I note that it seeks to expunge a Title 21 offense of disregarding a red light in which she received probation before judgment and was discharged. She also has another Title 21 offense in which she pled guilty, i.e. a speeding ticket. Therefore, after considering whether or not the continued existence and possible dissemination of the information concerning a rules of the road Title 21 offense causes manifest injustice and considering that she has a conviction on her driving record, I deny the application for expungement of criminal record. IT IS SO ORDERED. Yours very truly, T. Henley Graves THG:baj cc: Prothonotary
