IN THE COURT OF CHANCERY OF THE STATE OF DELAWARE CHARLINA PATTERSON, Plaintiff, v. RODNEY MITCHELL, JR., TERESA MITCHELL, his wife, ) ) ) ) ) ) ) ) C.A. No. 3526-MG MASTER S REPORT (Motion for Summary Judgment) Date Submitted: September 16, 2009 Draft Report: October 27, 2009 Final Report: November 17, 2009 Charlina Patterson, Pro Se, Plaintiff. Thomas P. Preston, Esquire, of Blank Rome LLP, Wilmington, Delaware, Attorney for Mitchell Defendants. GLASSCOCK, Master The Mitchell defendants filed a motion for summary judgment and supporting brief on July 10, 2009. A schedule was established for the plaintiff to file her answer to the motion for summary judgment. The plaintiff failed to file an answer to the motion by the established date. The Court extended the date for the plaintiff to respond to the motion, and notified the plaintiff that if no response was received by September 15, 2009, the matter would be considered unopposed. The plaintiff has not filed a response to the motion. Since the motion for summary judgment is unopposed, and since it appears that grounds to grant the motion are otherwise in the record, the defendants are entitled to a judgment. The Mitchell defendants motion for summary judgment is granted. /s/ Sam Glasscock, III Master in Chancery cc: Gregory A. Morris, Esquire John W. Paradee, Esquire 2
