No. TA011942 MODIFICATION OF OPINION THE COURT: The opinion herein, appearing at 37 Cal.4th 839, is modified as follows: In 37 Cal.4th at page 896, in the paragraph continued from page 895, delete sentence reading The constitutional claims, of course, are forfeited. In the following sentence, delete also. As modified, the last two sentences of the paragraph now read: Defendant renews his objections here and, for the first time, adds that the photographs violated his rights under the Fifth, Sixth, Eighth, and Fourteenth Amendments. Defendant s claims fail on the merits. In the second full paragraph of 37 Cal.4th at page 902, after the sentence reading Nor does he claim the prosecutor lacked a good-faith basis for inquiring about these incidents. insert (See People v. Clair (1992) 2 Cal.4th 629, 683684.) These modifications do not affect the judgment.
