UNION PACIFIC CORPORATION et al., Cross-complainants and Respondents, v. RICHARD WENGERT, Cross-defendant and Appellant.

[Modification of Opinion (79 Cal.App.4th 1444) on denial of petition for rehearing.]

THE COURT- Respondents' petition for rehearing is denied. The opinion filed herein on April 21, 2000, is modified to add the following sentence to the disposition, [79 Cal. App. 4th 1452, advance report, 1st par., line 1], after the first sentence: "Any retrial shall be limited to the issue of what percentage of the settlement represents a reasonable compromise of Richard Carroll's claim for economic damages."
