People v. Rodriguez (2000)

Annotate this Case
[No. F031606. Fifth Dist. Feb. 28, 2000.]

THE PEOPLE, Plaintiff and Respondent, v. DAVID MICHAEL RODRIGUEZ, Defendant and Appellant.

[Modification of opinion (77 Cal.App.4th 1101) on denial of petition for rehearing.]

VARTABEDIAN, J.-It is ordered that the opinion filed herein on January 28, 2000, and reported in the Official Reports (77 Cal.App.4th 1101) be modified in the following particulars:

1. On page 1105, line 12, the last sentence in the paragraph is modified by inserting the word "partially" between the words "were" and "surrounded" so that the sentence as modified reads:

The home and the home office were partially surrounded by the same chain-link fence.

2. On page 1108, the second sentence of the fifth full paragraph is deleted and the first sentence of that paragraph is modified to read as follows:

The common walkway and driveway increased the functionality of the setup, as did the chain-link fence.

This modification does not change the judgment.

The petition for rehearing is denied.

Ardaiz, P. J., and Buckley, J., concurred.
