THE COURT:
It is ordered that the opinion filed herein on April 19, 2012, be modified as
follows:
1. On page 3, line 6 of footnote 3, beginning âAfter the trial court entered an
amended judgment,â the remainder of the sentence is deleted and the words
âArvinMeritor and Abex each appealed from the amended judgment, and the resulting
appeals were both assigned case number A132985 (the joint appeal)â are inserted in its
place, so that the full sentence reads as follows:
After the trial court entered an amended judgment, ArvinMeritor and Abex
each appealed from the amended judgment, and the resulting appeals were
both assigned case number A132985 (the joint appeal).
2. On page 3, in the last sentence of footnote 3, beginning âA separate opinion,â
the word âAbexâsâ is inserted between the words âandâ and âportionâ; in the same
sentence, the words âwhich has been redesignated as case number A135224 (Order,
Apr. 23, 2012, Ruvolo, P.J.)â are added following the words âjoint appeal,â so that the
last full sentence of footnote 3 reads as follows:

A separate opinion will address Abexâs separate appeal and Abexâs portion
of the joint appeal, which has been redesignated as case number A135224
(Order, Apr. 23, 2012, Ruvolo, P. J.).
There is no change in the judgment.
