ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING [THERE IS NO CHANGE IN THE JUDGMENT] THE COURT: It is ordered that the opinion filed herein on April 21, 2008, be modified as follows: The last two sentences of footnote 13, found on page 22, are deleted. Thus, the first paragraph of footnote 13 will read: 13 Plaintiff alleged that defendant San Jose Advantage Homes, Inc. began advertising the spaces in the new section of the park at the end of February 2003, after the February 11, 2003, letter. This allegation was supported by a copy of an undated advertisement, Exhibit 14. On page 27, delete the first sentence of the second full paragraph beginning with Also, plaintiff has not and in its place insert the following sentence: Also, plaintiff has not alleged the uniqueness or desirability shown in Surburban. The petition for rehearing is denied. There is no change in the judgment.
