David Grant filed a petition for writ of mandamus in this court contending that the Honorable Tom Keith, Circuit Judge, had failed to act within a reasonable time on a motion to dismiss charges for failure to prosecute filed in the Circuit Court of Benton County on March 25, 2004. On July 28, 2004, Judge Keith entered an order disposing of the motion. As the circuit court has acted in the matter, the petition for writ of mandamus is moot.
