James H. Williams filed a petition for writ of mandamus in this court contending that the Honorable David Burnett, Circuit Judge, had failed to act within a reasonable time on a petition for writ of habeas corpus pursuant to Act 1780 of 2001 that was filed in the Circuit Court of Mississippi County, Osceola District, on July 31, 2001. Petitioner Williams now asks that the petition for writ of mandamus be dismissed without prejudice because the habeas petition has been set for hearing.

Motion granted.
