MICHAEL JAY RAMAKER

Petitioner

v.

HONORABLE DAVID CLINGER, JUDGE

Respondent

CR 03-664

PRO SE PETITION FOR WRIT OF MANDAMUS [CIRCUIT COURT OF BENTON COUNTY, NO. CR 98-5527-2]

PETITION MOOT

Per Curiam

Michael Jay Ramaker filed a petition for writ of mandamus in this court contending that the Honorable David Clinger, Circuit Judge, had failed to act within a reasonable time on a petition for postconviction relief pursuant to Criminal Procedure Rule 37.1 filed in the Circuit Court of Benton County on November 5, 2001. Upon receipt of the petition, Judge Clinger caused to be forwarded to this court a certified copy of an order entered November 5, 2002, that dismissed the Rule 37.1 petition.

As the circuit court has acted in the matter, the petition for writ of mandamus is moot.

Petition moot.
