Almer Willis Wright filed a petition for writ of mandamus in this court contending that the Honorable Phillip Shirron, Circuit Judge, had failed to act on a motion for extension of time to lodge an appeal record filed in the Circuit Court of Hot Spring County on January 27, 2003. On February 6, 2003, Judge Shirron entered an order denying and dismissing the motion, finding that the appeal record had been prepared by the clerk and was available on February 1, 2003, for petitioner Wright to obtain and lodge in the appellate court. As the circuit court has acted in the matter, the petition for writ of mandamus is moot.
