Alternatively, Progressive claimed that the action was due to be transferred to Tuscaloosa County on the ground of the doctrine of forum non conveniens. Upon review, the Supreme Court held that, based on the evidence before the trial court at the time of its ruling, it should have granted Progressive's motion for a change of venue.
