M a r k Brown was a r e s i d e n t of Calhoun County. He had r e c e i v e d money f r o m Reo W i l l i a m B e n e f i e l d i n t h e p a s t . M a r k Brown a l l e g e d t h i s was 'hush money' f o r p a s t s e x u a l abuse he r e c e i v e d f r o m Reo. An a g r e e m e n t was made b e t w e e n Mark Brown, Shannon Brown and Tim M o r r i s t o g e t money f r o m Reo B e n e f i e l d and h i s r e l a t i v e s t h a t l i v e d i n t h e h o u s e w i t h him. The morning of F e b r u a r y 8, 2005, M a r k Brown, Shannon Brown and Tim M o r r i s met a t Mark Brown's r e s i d e n c e i n C a l h o u n County. T h e y l e f t t h e r e s i d e n c e a r o u n d 7 a.m. and went t o W a l - M a r t i n O x f o r d . Mark Brown t o o k h i s s o n ' s b a s e b a l l b a t w i t h him when he l e f t . A t WalMart, the t h r e e purchased 3 r o l l s of duct tape, 3 s k i masks and 3 p a i r s o f g l o v e s . T h i s was confirmed by v i d e o s u r v e i l l a n c e o f t h e p a r k i n g l o t o f t h e s t o r e as w e l l as a camera a t t h e r e g i s t e r where t h e i t e m s were p u r c h a s e d . The t h r e e s o m e t h e n t r a v e l e d t o C l e b u r n e C o u n t y where t h e y made a s t o p a t T i m Morris' s i s t e r ' s residence. Mr. M o r r i s g o t a gun t h a t he had l e f t t h e r e . T h e y t h e n p r o c e e d e d t o t h e Benefield residence. They h i d t h e m s e l v e s i n an a b a n d o n e d c h i c k e n house t h a t Reo B e n e f i e l d u s e d as 4 CR-08-0805 a w o r k s h o p . The t h r e e c o - d e f e n d a n t s c o n f r o n t e d Reo. They b o u n d h i m a n d p l a c e d a dog f o o d b a g o v e r h i s head. A f t e r a s s a u l t i n g Reo w h i l e i n t h e c h i c k e n h o u s e , t h e d e f e n d a n t s t o o k Reo t o t h e r e s i d e n c e . Lena Benefield, Shable Benefield and Durward B e n e f i e l d were p r e s e n t a t t h e r e s i d e n c e . " W h i l e i n s i d e , S h a b l e B e n e f i e l d was f o r c e d t o w r i t e two c h e c k s ( C o l o n i a l Bank #0208 i n t h e amount of $11,480.00 a n d S o u t h T r u s t Bank #1423 i n t h e amount o f $8,590.00) p a y a b l e t o Reo B e n e f i e l d . Mark Brown t o o k a t r u c k b e l o n g i n g t o S h a b l e B e n e f i e l d . He a n d Reo B e n e f i e l d went t o b o t h b a n k s a n d c a s h e d the checks. T h e s e t r a n s a c t i o n s were c o n f i r m e d by w i t n e s s t e s t i m o n y f r o m p e r s o n n e l f r o m e a c h bank a n d v i d e o s u r v e i l l a n c e from t h e banks. Additionally, the c h e c k drawn on t h e C o l o n i a l Bank a c c o u n t h a d body f l u i d s on i t w h i c h was f o u n d t o c o n t a i n t h e DNA of Reo B e n e f i e l d a n d Mark Brown. M a r k Brown a n d Reo B e n e f i e l d then r e t u r n e d t o the r e s i d e n c e . " A t some p o i n t , a l l o f t h e v i c t i m s e x c e p t 88 y e a r o l d L e n a B e n e f i e l d were b o u n d w i t h d u c t t a p e s e c u r i n g t h e i r hands and f e e t . A d d i t i o n a l l y , duct t a p e was p l a c e d o v e r t h e i r mouth and e y e s . A l l v i c t i m s were b e a t e n a b o u t t h e h e a d . Reo B e n e f i e l d d i e d as a r e s u l t o f b l u n t f o r c e t r a u m a . The o t h e r s were b e a t e n u n t i l t h e y were u n c o n s c i o u s . Two f i r e s were s e t i n t h e h o u s e a n d t h e d e f e n d a n t s l e f t t h e residence. Lena, S h a b l e and Durward B e n e f i e l d a l l d i e d from a c o m b i n a t i o n o f b l u n t f o r c e trauma and from i n h a l i n g p a r t i c l e s o f combustion from t h e f i r e . S i g n s were f o u n d on t h e i r f a c e s i n d i c a t i n g t h e y i n h a l e d smoke f r o m t h e f i r e . Additionally, their b l o o d c o n t a i n e d i n d i c a t o r s t h a t t h e i r l u n g s had p r o c e s s e d t h e smoke. "When the defendants left the Benefield r e s i d e n c e , they took Shable B e n e f i e l d ' s t r u c k t h a t h a d been u s e d by Mark Brown t o d r i v e t o t h e b a n k s . The d e f e n d a n t s t o o k p a r t o f t h e money a n d b r o u g h t a truck. A d e s c r i p t i o n o f t h i s t r u c k was r e l a y e d t o 5 CR-08-0805 l o c a l law enforcement. The t r u c k was s p o t t e d b y Cleburne County d e p u t i e s . The t r u c k was s t o p p e d . Shannon Brown was d r i v i n g . M a r k Brown a n d T i m M o r r i s jumped o u t o f t h e t r u c k a n d r a n . Shannon Brown was f o u n d i n p o s s e s s i o n o f $6,800.00 i n c a s h i n c l u d i n g one s t a c k w i t h a S o u t h T r u s t b a n k w r a p p e r . "Mark Brown was f o u n d a s h o r t t i m e l a t e r . A f t e r he was t a k e n i n t o c u s t o d y , an amount o f c u r r e n c y ($8,000) was turned into the Cleburne County S h e r i f f ' s O f f i c e b y an i n d i v i d u a l who l i v e d a t t h e r e s i d e n c e where Mark Brown h a d b e e n h i d i n g . "Mark Brown was g i v e n h i s c o n s t i t u t i o n a l r i g h t s and he gave a s t a t e m e n t r e g a r d i n g h i s i n v o l v e m e n t i n the crime." (C.R. 73-75.) Brown argues that "[t]he trial when i t i n s t r u c t e d t h e j u r y t h a t court reversibly erred i t could c o n v i c t [ h i m ] of c a p i t a l m u r d e r e v e n i f he d i d n o t p o s s e s s t h e s p e c i f i c i n t e n t to kill." (Brown's b r i e f contends t h a t "the t r i a l that at p. 11.) Specifically, he court repeatedly i n s t r u c t e d the j u r y [he] c o u l d be c o n v i c t e d o f c a p i t a l m u r d e r as l o n g as one of h i s co-defendants possessed the s p e c i f i c (Brown's b r i e f a t p. 12.) Therefore, he c o n c l u d e s jury believed that i t could convict even the r e q u i s i t e i f he d i d not possess (Brown's b r i e f a t p. 12.) intent to kill." that "the [him] o f c a p i t a l murder intent to B e c a u s e Brown d i d n o t p r e s e n t 6 kill." this CR-08-0805 argument to the t r i a l court, we r e v i e w i t f o r p l a i n error. " C a r n e s , 42 A l a . Law a t 471. "'Our d u t y on a p p e a l was s t a t e d i n R a i n e s , 429 So. 2d a t 1113. "To a f f i r m a f i n d i n g o f a ' p a r t i c u l a r i z e d i n t e n t to k i l l ' , t h e j u r y must be p r o p e r l y c h a r g e d on the i n t e n t t o k i l l i s s u e , a n d t h e r e must be s u f f i c i e n t e v i d e n c e f r o m w h i c h a r a ti o n a l io j u r y could conclude that the defendant possessed the i n t e n t to k i l l . " ' " L e w i s v. S t a t e , App. 1 9 8 4 ) . " Rowell v. State, 570 456 So. 2d 413, 416-17 So. 2d 848, 850-51 (Ala. Cr. ( A l a . Crim. App. 1990). When i t f i r s t trial court i n s t r u c t e d the jury regarding i n t e n t , the stated: "Now, l a d i e s a n d g e n t l e m e n , t h e c r i m e c h a r g e d i n t h i s c a s e , c r i m e s I s h o u l d s a y , i s a s e r i o u s cr i m e r: which r e q u i r e s proof of s p e c i f i c i n t e n t before the d e f e n d a n t c a n be c o n v i c t e d . S p e c i f i c i n t e n t , as t h e t e r m i m p l i e s , means more t h a n a g e n e r a l i n t e n t t o commit t h e a c t . To e s t a b l i s h s p e c i f i c i n t e n t , t h e S t a t e must p r o v e t h a t a d e f e n d a n t k n o w i n g l y d i d an 8 CR-08-0805 act let w h i c h t h e l a w f o r b i d s o r k n o w i n g l y -- I'm s o r r y , me r e a d t h a t a g a i n . "To e s t a b l i s h s p e c i f i c i n t e n t , t h e S t a t e must p r o v e t h a t t h e d e f e n d a n t k n o w i n g l y d i d an a c t w h i c h the law f o r b i d s , p u r p o s e l y i n t e n d e d t o v i o l a t e the law. Such i n t e n t may be d e t e r m i n e d f r o m a l l t h e f a c t s and c i r c u m s t a n c e s s u r r o u n d i n g t h e c a s e . A person i s l e g a l l y accountable f o r the b e h a v i o r o f a n o t h e r p e r s o n c o n s t i t u t i n g a c r i m e if, with the intent t o promote o r a s s i s t t h e commission of the crime, he e i t h e r procures, i n d u c e s , o r c a u s e s s u c h o t h e r p e r s o n t o commit t h e crime; o r , a i d s o r abets such o t h e r person i n c o m m i t t i n g t h e c r i m e ; o r , has a l e g a l duty t o p r e v e n t t h e commission o f t h e crime and f a i l s t o make s u c h e f f o r t as he i s l e g a l l y r e q u i r e d t o make to p r e v e n t i t . "Now, a p e r s o n i s n o t l e g a l l y a c c o u n t a b l e f o r the behavior of another person c o n s t i t u t i n g the crime i f e i t h e r he's a v i c t i m o f t h a t crime o r t h e c r i m e i s d e f i n e d i n s u c h a way t h a t h i s c o n d u c t i s i n e v i t a b l y i n c i d e n t a l t o i t s commission; o r , b e f o r e the commission of the crime, he voluntarily t e r m i n a t e s h i s e f f o r t t o promote o r a s s i s t i t s c o m m i s s i o n a n d he g i v e s t i m e l y a n d a d e q u a t e w a r n i n g t o l a w e n f o r c e m e n t a u t h o r i t i e s ; o r , gave t i m e l y a n d adequate warning t o t h e i n t e n d e d v i c t i m ; o r , w h o l l y deprived h i s c o m p l i c i t y of i t s effectiveness i n the commission o f t h e crime. A n d t h e b u r d e n i s on t h e State t o prove that the defendant d i d not v o l u n t a r i l y t e r m i n a t e h i s e f f o r t t o promote o r a s s i s t the commission o f t h e crime charged." 9 CR-08-0805 (R. 2446-47.) When i t i n s t r u c t e d the indictment, jury i . e . , the c a p i t a l r o b b e r y of Lena, the t r i a l regarding offense Count I of the o f murder d u r i n g the court stated, i n part: "A p e r s o n a c t s i n t e n t i o n a l l y when i t i s h i s p u r p o s e t o c a u s e t h e d e a t h o f a n o t h e r p e r s o n . The i n t e n t t o k i l l must be r e a l , and i t must be s p e c i f i c . " (R. 2449.) I t also stated: "A p e r s o n a c t s i n t e n t i o n a l l y w i t h r e s p e c t t o a r e s u l t o r t o c o n d u c t when h i s o r h e r p u r p o s e i s t o c a u s e t h a t r e s u l t o r t o engage i n t h a t c o n d u c t . " (R. 2450.) When i t i n s t r u c t e d t h e indictment, i . e . , the jury regarding capital robbery of Shable, the t r i a l offense Count I I of the o f murder d u r i n g the court stated, i n part: "To c o n v i c t , t h e S t a t e must p r o v e b e y o n d a r e a s o n a b l e doubt each of the f o l l o w i n g elements of an i n t e n t i o n a l m u r d e r d u r i n g r o b b e r y i n t h e f i r s t degree: "That S h a b l e B e n e f i e l d i s dead. " T h a t t h e d e f e n d a n t , Mark Brown, c a u s e d t h e d e a t h , o r someone e l s e , as he a i d e d and a b e t t e d them, t h a t b e i n g , t o w i t , Shannon Wayne Brown o r Timothy P a t r i c k M o r r i s , caused the death of Shable B e n e f i e l d by s t r i k i n g h i m w i t h a b l u n t o b j e c t , t o wit, a b a s e b a l l b a t , and by c a u s i n g h i m t o i n h a l e p r o d u c t s of combustion from a f i r e . 10 CR-08-0805 "That i n c o m m i t t i n g t h e s e a c t s w h i c h c a u s e d t h e death of Shable B e n e f i e l d , the defendant i n t e n d e d t o k i l l the deceased, o r another person, or another i n d i v i d u a l who he a i d e d a n d a b e t t e d i n t e n d e d t o kill. "A p e r s o n a c t s i n t e n t i o n a l l y when i t i s h i s p u r p o s e t o c a u s e t h e d e a t h o f a n o t h e r p e r s o n . The intent to k i l l must be r e a l a n d i t must be specific." (R. 2458-59) (emphasis When i t i n s t r u c t e d indictment, added). the jury i . e . , the c a p i t a l r o b b e r y o f Reo, t h e t r i a l regarding Count I I I o f t h e o f f e n s e o f murder d u r i n g t h e court stated, i n part: "To c o n v i c t , t h e S t a t e must p r o v e b e y o n d a r e a s o n a b l e doubt each o f t h e f o l l o w i n g elements o f an i n t e n t i o n a l m u r d e r d u r i n g r o b b e r y i n t h e f i r s t degree: "That i n c o m m i t t i n g t h e a c t s w h i c h caused t h e d e a t h o f Reo B e n e f i e l d , t h e d e f e n d a n t i n t e n d e d -¬ the defendant, or another p a r t i c i p a n t , intended t o k i l l the deceased or another person. A person acts i n t e n t i o n a l l y when i t i s h i s p u r p o s e t o c a u s e t h e d e a t h o f a n o t h e r p e r s o n .
