On remand to this court, and in compliance with the supreme court's opinion, the judgment entered by the Montgomery Circuit Court granting the motion for a summary judgment filed by Lance R. LeFleur, in his official capacity as director of the Alabama Department of Environmental Management, and denying the summary-judgment motion filed by Ronald C. Smith, Latonya Gipson, and William T. Gipson is hereby affirmed. AFFIRMED. Thompson, P.J., and Donaldson, Edwards, and Hanson, JJ., concur. 2
