54.1-3427. Dispensing drugs without safety closure container.

When a pharmacist receives the request of any person that a drug or drugs forsuch person to be dispensed by the pharmacist not be placed in a safetyclosure container, the pharmacist may dispense such drug or drugs in suchnonsafety closure container. The delivering pharmacist shall not be civillyliable simply by reason of dispensing a drug or drugs in such a container ifthe recipient signs a release covering a period of time or a single delivery,which release provides that the recipient releases the pharmacist from civilliability for not using the safety closure container, unless the pharmacistacted with willful and wanton disregard of safety.
