16.1-278.7:01. Department to give notice of the receipt of certain persons.

A. At the time or receipt of any person, for whom registration with the SexOffender and Crimes Against Minors Registry is required pursuant to Chapter 9( 9.1-900 et seq.) of Title 9.1, the Department shall obtain from thatperson all necessary registration information, including fingerprints andphotographs of a type and kind approved by the Department of State Police. Aperson required to register shall register and submit to be photographed aspart of the registration. The Department shall forthwith forward theregistration information and photograph to the Department of State Police onthe date of the receipt of the person.

B. Whenever a person required to register has failed to comply with theprovisions of subsection A, the Department shall promptly investigate orrequest the State Police promptly investigate and, if there is probable causeto believe a violation has occurred, obtain a warrant or petition or assistin obtaining an indictment charging a violation of 18.2-472.1 in thejurisdiction in which the person was received. The Department shall notifythe State Police forthwith of such actions taken pursuant to this section.
