16.1-249.1. Places of confinement to give notice of intake of certainpersons.

A. At the time of receipt of any person, for whom registration with the SexOffender and Crimes Against Minors Registry is required pursuant to Chapter 9( 9.1-900 et seq.) of Title 9.1 into a secure facility, the secure facilityshall obtain from that person all necessary registration information,including fingerprints and photographs of a type and kind approved by theDepartment of State Police. A person required to register shall register andsubmit to be photographed as part of the registration. The facility shallforthwith forward the registration information to the Department of StatePolice on the date of the receipt of the prisoner.

B. Whenever a person required to register has failed to comply with theprovisions of subsection A, the facility shall promptly investigate orrequest the State Police promptly investigate and, if there is probable causeto believe a violation has occurred, obtain a warrant, or assist in obtainingan indictment charging a violation of 18.2-472.1 in the jurisdiction inwhich the person was received. The facility shall notify the State Policeforthwith of such actions taken pursuant to this section.
