2006 Code of Virginia § 10.1-1425.4 - Lead acid battery wholesalers; penalty

10.1-1425.4. Lead acid battery wholesalers; penalty.

A. It shall be unlawful for any person selling new lead acid batteries atwholesale to not accept from customers at the point of transfer, used leadacid batteries of the type and in a quantity at least equal to the number ofnew batteries purchased, if offered by customers. A person acceptingbatteries in transfer from a battery retailer shall be allowed a period notto exceed ninety days to remove batteries from the retail point of collection.

B. Any person found guilty of a violation of this section shall be punishedby a fine of not more than fifty dollars. Each battery unlawfully refused bya wholesaler or not removed from the retail point of collection within ninetydays shall constitute a separate violation.
