10.1-1425.26. Cathode ray tube special waste recycling program.

A. As used in this section "cathode ray tube" means an intact glass tubeused to provide the visual display in televisions, computer monitors,oscilloscopes and similar scientific equipment, but does not include theother components of an electronic product containing a cathode ray tube evenif the product and the cathode ray tube are disassembled.

B. The Board shall promulgate regulations to encourage cathode ray tube andelectronics recycling.

C. Any locality may, by ordinance, prohibit the disposal of cathode ray tubesin any privately operated landfill within its jurisdiction, provided thelocality has implemented a recycling program that is capable of handling allcathode ray tubes generated within its jurisdiction. However, no suchordinance shall contain any provision that penalizes anyone other than theinitial generator of such cathode ray tubes.
