8.01-44.2. Action against physician for vaccine-related injury or death.

In any case where a person could file or could have filed a petition forcompensation pursuant to Subtitle 2 of Title XXI of the Public HealthServices Act of the United States (42 U.S.C. 300aa-10 et seq.) for thevaccine-related injury or death associated with the administration of avaccine in the Commonwealth by or under the supervision of a physicianlicensed to practice medicine in Virginia, no civil action shall lie againstsuch physician, or any person administering such vaccine on behalf of suchphysician for injury or death resulting from an adverse reaction to suchvaccine, except where such injury or death was caused by gross negligence ofthe physician, his agents or employees, in the administration of such vaccine.
