3.1-249.76. Summary suspension by Commissioner; procedure.

The Commissioner may suspend the license of any person licensed or certifiedwithout a hearing simultaneously with the institution of proceedings for ahearing, if he finds there is a substantial danger to the public health,safety, or the environment which warrants this action. Institution ofproceedings for a hearing shall be provided simultaneously with the summarysuspension. The hearing shall be scheduled within a reasonable time of thedate of the summary suspension.

Any licensee or certificate holder whose license or certificate has beensuspended shall not engage in the activity for which he has been certified orlicensed pending the hearing.
