3.1-249.46. Annual business license required.

A. No pesticide business may sell, distribute, or store any pesticide inVirginia without a valid pesticide business license issued pursuant toregulations promulgated by the Board. The Board shall promulgate regulationswhich exempt retailers of limited quantities of nonrestricted use pesticidesincluding grocery stores, convenience stores, drug stores, veterinarians andother businesses who sell pesticides primarily for limited household use.

B. No person or business may apply or recommend for use commercially inVirginia any pesticide without a valid pesticide business license issuedpursuant to regulations promulgated by the Board. Such business shall employa certified commercial applicator who is responsible for (i) the safeapplication of the pesticides and (ii) providing recommendations for the useof pesticides.

C. An annual business license and fee shall be required for each location oroutlet that sells, distributes, stores, applies, or recommends for use anypesticide in Virginia unless otherwise exempt pursuant to the provisions ofthis section.

D. An application for a pesticide business license shall be submitted in suchmanner and form as prescribed by the Board.
