§ 418a. Psychological tests

  • (a) In addition to the powers and duties specified in section 418 of this chapter, the Department of Health is authorized and directed to administer psychological and drug and alcohol abuse tests to any person or security guard as defined in subsection (g) of section 1301, Title 23, Virgin Islands Code, to determine his or her fitness to carry out his or her job-related duties and responsibilities through the measurement of capacity for stress, intelligence, honesty, judgment, control of aggression, and general mental health.

  • (b) The tests authorized in subsection (a) of this section shall be conducted four times each year by the Department of Health; Provided, That the Department of Health shall cause to be published in two newspapers of general circulation in the Territory notices of such tests at least two weeks in advance of each such test, such notices to include, but not be limited to, information regarding the types of tests to be conducted, the dates and times of such tests, the location of the place or places where such tests are to be conducted, the fee required to be paid, and a statement indicating the successful completion of such tests is a prerequisite for the issuance of a license to have and possess firearms for persons employed by private security guard or investigative agencies.

  • (c) Prior to administering the psychological and drug and alcohol abuse tests authorized in subsection (a) of this section to any person, the Department of Health shall cause to be collected from such person a fee equal to the actual costs of administering such tests, such fee to include a reasonable allowance for overhead.
