Subchapter II - Traders in Gold, Silver and Other Valuable Items
§ 312. Requirement for record

  • (a) Any trader doing business in the locations permitted in this subchapter shall record the purchase, barter, exchange, pledge, or other receipt by him of any item described in section 310 of this subchapter, and also any subsequent disposition of that item from his possession. Recording shall be on forms obtainable from the U.S. Virgin Islands Police Department (V.I.P.D.) and shall include:

    • (1) The date of the transaction;

    • (2) A comprehensive description of the item including any visible identification marks such as initials, name of manufacturer, model and serial numbers and owner-applied identification numbers;

    • (3) Its estimated fair market value;

    • (4) The name, address, and date of birth of the person from whom the item is received. The trade shall require proof of identification of that person by a driver's license or similar credentials.

    • (5) The records required by this section must be kept for inspection for not less than five years.

  • (b) The requirements imposed upon a trader by this section shall also be binding upon any employee or other person acting for the trader.

  • (c) The completed form shall be transmitted by the trader to the U.S. Virgin Islands Police Department (V.I.P.D.) no later than 5 days after the date of any transaction listed on the form.

  • (d) In addition to the requirements enumerated in subsections (a) (b) and (c) of this section, all transactions must be video recorded showing the faces of the consumer and the trader and the date and time of the transaction and the recording must be kept for inspection not less than 90 days from the time of the recording.
