§ 303. Introducing bodily fluid or waste into food or drink

  • (a) Any person who knowingly introduces any bodily fluid or bodily waste into the food or drink of a correctional officer, staff member, private contractor or employee of any correctional facility or court of the Virgin Islands, police officer or authorized visitor to a correctional facility or court shall be guilty of a felony punishable by imprisonment for not more than five (5) years and subject to a fine of up to $5,000. Such sentence must be served consecutively to any sentence currently being served and does not preclude the imposition of any additional administrative penalty of the correctional facility.

  • (b) Any person who knowingly introduces any bodily fluid or bodily waste into the food or drink of a person not listed in subsection (a) shall be guilty of a misdemeanor punishable by imprisonment for not more than six (6) months and subject to a fine of up to $1,000.
