Chapter 9 - Air Pollution Control
§ 218. Notification to EPA and neighboring states

  • (a) The Department:

    • (1) shall transmit to the U.S. Environmental Protection Agency a copy of each permit application, including any application for a permit modification or renewal, or such portion thereof, including any compliance plan, as the Administrator may require to carry out the Administrator's responsibilities under the Clean Air Act, as amended, and

    • (2) shall provide to the Administrator a copy of each permit proposed to be issued and issued as a final permit.

  • (b) The Department shall notify all States and Territories:

    • (1) whose air quality may be affected and that are within fifty (50) miles of the island in which the emission originates, or

    • (2) that are within fifty (50) miles of the source, of each permit application or proposed permit forwarded to the Administrator under this section, and shall provide an opportunity for such states and territories to submit written recommendations respecting issuance of the permit and its terms and conditions. If any part of those recommendations are not accepted by the Department, the Department shall notify the state or territory submitting the recommendations and the Administrator in writing of its failure to accept those recommendations and the reasons therefor.

  • (c) Objection by EPA

    • No permit shall be issued if the Administrator objects to its issuance in a timely manner.
