§ 367. Inspection; sampling; analysis
§ 367. Inspection; sampling; analysis
For the purpose of enforcing this chapter and determining whether fertilizers, beneficial substances, and lime distributed in this State endanger the health and safety of Vermont citizens, the Secretary upon presenting appropriate credentials is authorized:
(1) To enter any public or private premises except domiciles during regular business hours and stop and enter any vehicle being used to transport or hold fertilizer, beneficial substances, or lime.
(2) To inspect blending plants, warehouses, establishments, vehicles, equipment, finished or unfinished materials, containers, labeling, and records relating to distribution, storage, or use.
(3) To sample and analyze any fertilizer, beneficial substance, or lime. The methods of sampling and analysis shall be those adopted by the Association of Official Analytical Chemists. In cases not covered by this method or in cases where methods are available in which improved applicability has been demonstrated, the Secretary may authorize and adopt methods that reflect sound analytical procedures.
(4) To develop any reasonable means necessary to monitor and adopt rules for the use of fertilizers, beneficial substances, and lime on Vermont soils where monitoring indicates environmental or health problems. In addition, the Secretary may develop and adopt rules for the proper storage of fertilizers, beneficial substances, and lime held for distribution or sale. (Added 1985, No. 126 (Adj.
