§ 1740. Payment of expenses; from estate, if sufficient

At the time of partition or distribution of an estate, if the executor or administrator has retained sufficient effects in his hands which may lawfully be applied for that purpose, the expenses of such partition or distribution may be paid by the executor or administrator when it appears to the court equitable and not inconsistent with the intention of a testator.
