24A V.S.A. § 51 What's This?

3-51. Ordinance enforcement

(a) The violation of an ordinance, regulation, or by-law adopted by the City, including zoning and subdivision by-laws adopted pursuant to 24 V.S.A. chapter 117, as the same may be amended from time to time, may be prosecuted as a criminal or civil action.

(b) All penalties collected for the violation of an ordinance, regulation, or by-law shall be paid over to the City except for a surcharge that shall be set and retained by the Court.

(c) A Superior or District Court judge shall have the jurisdiction to enjoin the violation of an ordinance or rule but the election of the City to proceed under this subsection shall not prevent its proceeding under subsection (a) of this section. (Amended 1999, No. M-7, 3, eff. May 19, 1999.)
