§ 401 Action requiring an ordinance

19-401. Action requiring an ordinance

In addition to other acts required by law or by specific provisions of this charter to be done by ordinance, those acts of the City Council shall be by ordinance which:

(1) provide for a fine or other penalty or establish a rule or regulation for violation of which a fine or other penalty is imposed;

(2) levy taxes, including any voter-authorized local option tax, and special benefit assessments, except as otherwise provided in Article 6 of this charter with respect to the property tax levied by adoption of the budget:

(3) grant, renew, or extend a franchise;

(4) regulate the rate charged for municipal water, sewer (acting as the commission), and utility services, and for the operation of such enterprises;

(5) adopt with or without amendment ordinances proposed under the initiative power;

(6) amend or repeal any ordinance previously adopted, except as otherwise provided in Article 8 of this charter with respect to repeal of ordinances reconsidered under the referendum power. Acts other than those referred to in the preceding sentence may be done either by ordinance or by resolution; and

(7) establish, amend, or repeal a fee. (Added 2013, No. M-9, 3, eff. June 4, 2013.)
