§ 5704 Failure to appear

12 V.S.A. § 5704. What's This?

§ 5704. Failure to appear

If a defendant fails to appear or answer a uniform snowmobile/boating complaint or summons served upon him or her and upon which a complaint has been filed, the court shall promptly report the name of the defendant, the date and nature of the offense charged, and all other pertinent facts to the department of motor vehicles. The court shall mail a notice to the defendant at the address stated in the complaint stating that failure to appear will result in the suspension of his or her privilege to operate a vessel or snowmobile, in the form prescribed by the court administrator, and shall send a copy of the notice to the department of motor vehicles and file a copy with the complaint. The notice to the department of motor vehicles shall serve as a request to arrange for suspension of the privilege to operate a vessel or snowmobile within this state. The court also may issue an arrest warrant and may punish the defendant for contempt. (Added 1977, No. 207 (Adj. Sess.), § 3; amended 198
