§ 734. Supervisors may petition superior court, when

If a landowner does not sign such stipulation, the supervisors may petition the superior court to require such landowner to bring his or her land into conformity with the ordinance, and the court shall order such relief as it may deem necessary in the interest of public health, safety and welfare. However, no landowner shall by ordinance or otherwise be required to pay any money or perform any act which shall not be for the protection of his or her own land nor shall he or she be required to pay any money, perform any act or carry out any practice which shall not be in just proportion to the benefits which he or shewill receive and further provided that he or she shall not be required to pay any money, perform any act or carry out any practice which shall not be deemed to be necessary for the public good.
