Executive Order No. 10-8. (No. 24-86) [Program for Recycling of Waste Products and Revision of State Solid Waste Management Plan

WHEREAS, the State of Vermont can reduce the amount of waste that needs disposal by the reuse of all material that may be reused and the recycling of all that reasonably can be recycled; and

WHEREAS, by reusing recycled products, the State of Vermont can foster investment and employment opportunities in industries and businesses which are involved in source reduction, the reuse of waste and the recycling of waste; and

WHEREAS, the State of Vermont can serve as a model for the proper use of reused or recycled products and thus encourage reuse or recycling of waste products by all sectors of the Vermont economy, and

WHEREAS, the state in developing and updating its comprehensive statewide Solid Waste Management Plan should emphasize methods of reducing waste generation and recycling and reuse so as to minimize the amount of waste requiring disposal.

NOW, THEREFORE, I, Madeleine M. Kunin, Governor of Vermont, hereby direct:

1. The Secretary of Administration shall establish a recycling program to promote the reduction of waste generated by state agencies and to promote the separation and recovery of recyclable and reusable material. The secretary shall determine the economic feasibility and proper procedures for separation, collection and recycling of agencies' waste materials and develop recommendations under this program to identify and reduce the waste generated by state agencies. Where these recommendations can be implemented within the operating budgets of state agencies, the secretary shall direct that implementation. By January 15, 1987 and each odd-numbered year thereafter, the secretary shall submit a report on the recycling program to the Governor.

2. Consistent with the requirements of chapter 49 of 29 V.S.A., as of January 2, 1987, the Director of Purchasing shall review and modify all bid and product specifications relating to the purchase of recycled paper products and products utilizing not less than 50 percent post-consumer waste material so that the specifications encourage the maximum purchase of products made from recycled materials and recycled paper products. For the purpose of this section, "recycled materials" includes, but is not limited to, retreaded automobile tires, re-refined lubricating oil, and compost materials.

3. By January 15 of each odd-numbered year, the Director of Purchasing shall submit a report to the Governor summarizing the extent to which the state purchases products made from recycled materials and recycled paper products and stating proposed purchasing goals for the following biennium.

4. The Secretary of Environmental Conservation shall include in the Solid Waste Management Plan created pursuant to 10 V.S.A. section 6604, the following:

A. An evaluation of the State's existing industrial base, in order to determine the potential for increased private sector industrial or commercial use of recycled materials instead of virgin material, within the state. In developing this portion of the plan, the secretary shall consult with and receive the assistance of the Secretary of the Agency of Development and Community Affairs; and

B. A detailed consideration of alternatives for reducing the amount of solid waste requiring disposal in the state. The plan shall consider whether certain packaging containers and materials should be labeled to disclose particular disposal problems they may create; and

C. In addition to the contents of the plan specified in 10 V.S.A. section 6604(a), the plan shall provide for source reduction and composting.

5. In developing and revising the Solid Waste Management Plan pursuant to 10 V.S.A. section 6604, the Secretary shall be guided by the following policies where they are not inconsistent with the statement of policy expressed in 10 V.S.A. section 6601:

A. the long term preservation of the public safety, health and welfare shall be given top priority;

B. the goals of the plan shall be accomplished best by measures that emphasize the greatest possible reduction in the amount of waste generated and seek the reuse of material that may be reused and the recycling of all that reasonably can be recycled, in order to reduce to the greatest extent possible the amount of waste that needs disposal;

C. management systems shall be preferred which do not foreclose the future ability of the state to reduce the amount of waste which is generated, and to recycle waste which is generated;

D. management and disposal alternatives shall be evaluated in terms of their expected life-cycle costs;

E. the state shall foster investment and employment opportunities in industries and businesses which are involved in source reduction, the reuse of waste, and the recycling of waste so that to the maximum extent possible, materials which would otherwise end up in the waste stream are used for productive purposes;

F. the state will encourage its educational institutions and the private sector to initiate research and development activities which will lead to business and industry opportunities resulting in source reduction, reuse of waste and recycling;

G. to the extent that waste remains that requires disposal, the state shall encourage the development of price incentives on consumer products and on industrial and commercial waste by-products which allocate to the generator of waste the true life-cycle costs of disposing of the waste. In implementing this policy, the Secretary shall consult with the Commissioner of the Department of Taxes, representatives of the state's retail and manufacturing interests, representatives of other commercial concerns that may be affected by this procedure, representatives of environmental organizations, and representatives of consumer groups.

6. To the extent possible within existing resources, the Secretary shall provide technical assistance to municipalities to implement improved techniques and procedures for solid waste source reduction, reuse, recycling, disposal, management, planning, and in marketing where appropriate. Municipalities acting jointly shall be given priority.

7. The Secretary of Environmental Conservation shall require an applicant for certification of a solid waste treatment facility, site or activity pursuant to 10 V.S.A. section 6605(a) to include in the application consideration of the feasibility of various recycling options.

8. The additions to the Solid Waste Management Plan specified in section 4 of this order shall be made by December 1, 1986. The plan as a whole shall be revised and updated by December 1, 1986.

9. The Secretary of Environmental Conservation shall revise the Solid Waste Recycling Center Plan required by 24 V.S.A. section 2206 by December 1, 1986. The plan shall be included as part of the Solid Waste Management Plan when it is revised pursuant to Section 8.
