CHAPTER 3. GENERAL PROVISIONS RELATING TO RIVERS AND STREAMS

§ 143. Removal of obstructions

When floodwood, stone, gravel, sand, debris or rubbish deposited or resting in the bed of or on an island in a stream, changes or prevents the even flow of water between the main banks, or causes the stream to overflow its banks, or endangers property by obstructing or diverting the usual flow in times of high water, a person whose land is so endangered or injured may apply to the selectmen of the town where the obstructions are situated, or, if two such selectmen are interested or otherwise incapacitated to judge in the matter, to the selectmen in the adjoining town. In their discretion, such selectmen may authorize the applicant to remove the obstructions at his own expense; and, in removing them, the bed of the stream shall be made as nearly level between the main banks as is practicable.
