Subchapter II. Licenses to Sell-Procedure

§ 1660. License granted by court, when; notice; hearing

A probate division of the superior court shall not grant such license to deed the lands of a deceased person until notice has been given if it appears to the court upon a hearing that the assets in the hands of the executor or administrator will thereby be so reduced as to prevent a creditor from receiving his or her whole debt, or diminish his or her dividend.
