§ 909. Executor refusing trust, or not giving bond

A person named executor in a will who refuses to accept the trust or neglects to give a bond for 20 days after the probate of such will shall not intermeddle or act as executor. In case of such refusal to accept or neglect to give a bond, the probate division of the superior court may grant letters testamentary to the other executors who are capable and willing to accept the trust. If the other executors will not give a bond, administration, with the will annexed, shall be granted to the person who would have been entitled thereto had the testator died intestate.
