2005 Vermont Code - § 5516. — Commencement of proceedings

§ 5516. Commencement of proceedings

(a) Proceedings under this chapter shall be commenced as follows:

(1) By transfer to the juvenile court of a proceeding from another court as provided in section 5505 of this title, or

(2) By the filing of a petition as provided in this chapter.

(b) In the case of a petition to be filed with respect to a child alleged to be delinquent there shall be filed with the petition an approval in writing to the filing of the petition of the state's attorney having jurisdiction.

(c) Consistent with applicable provisions of Title 4, any proceeding concerning a child who is alleged to have committed an act specified in section 5506(a) of this title after attaining the age of 14 but not the age of 18 shall originate in district or superior court; provided, however, that jurisdiction may be transferred in accordance with this chapter.
