§ 702. Exceeding budget

The head of a state department, who is not elected by the people, shall not exceed the limits of the budget adopted by the general assembly for his department, and in the event that such limit is exceeded, the governor shall remove him after due notice and hearing. However, in case any unforeseen necessity arises whereby the budget limits may be exceeded in the particular department affected, then the payment of the same may be authorized from the contingent fund, on the approval of the governor and the state treasurer.
