§ 4493. Applicability of subdivision regulations
The subdivision regulations adopted under sections 102, 1203 and 1218 of Title 18, known as the Vermont health regulations, chapter 5, subchapter 10, shall not apply in any municipality which has adopted bylaws under subchapter 6 of this chapter provided that those bylaws provide substantially the same controls as provided in the Vermont health regulations and further provided that the commissioner of health has certified to the clerk of the municipality that those bylaws provide substantially the same controls. In case of the transfer of property by a municipality pursuant to a public sale for delinquent taxes, such subdivision regulations shall be deferred with respect to the municipality, but shall be applicable to any purchaser from the municipality at the public sale, and shall be made a term of any sale or lease of the property and recited in any deed conveyed by the municipality.
