§ 4417. Requirements by planning commission or the development review board
A planning commission or a development review board may require as a condition to the approval of any plat:
(1) That the streets and highways shall be of sufficient width and suitable grade and shall be so located to facilitate fire protection and coordinated so as to compose a convenient system properly related to the plan;
(2) That where zoning regulations are in effect, the plots shown on said plat shall comply with the requirements thereof;
(3) That the land shown on such plats shall be of such a character that it can be used safely for building purposes without danger to health or peril from fire, flood or other menace;
(4) That suitable monuments have been placed at street intersections and other necessary points as may be required, and the location thereof is shown on the map of such plat;
(5) That where indicated by the plan, the plat shall show a park or parks suitably located for playground or other recreation purposes, if the areas so required do not exceed more than fifteen percent of the area of the plat.
(6) That streets be laid out, buildings oriented, and vegetation controlled so as to promote the conservation of energy and to permit the utilization of renewable energy resources.
