§ 4404a. Adoption, amendment, or repeal of capital budget and program

(a) Notwithstanding any other provision of this chapter, a capital budget and program may be adopted, amended, or repealed by the legislative body of a municipality, following one or more public hearings, upon public notice, if a utility and facilities plan as described in section 4382(a)(4) of this title has been adopted by the legislative body in accordance with sections 4384 and 4385 of this title. A copy of the proposed capital budget and program shall be filed at least fifteen days prior to the final public hearing with the clerk of the municipality and the secretary of the planning commission. The planning commission may submit a report thereon to the legislative body prior to the public hearing.

(b) The capital budget and program, or amendment or repeal thereof, shall be adopted or rejected by an act of the legislative body of a municipality promptly after the final public hearing held under subsection (a) of this section.
