§ 5246. Sale or purchase of parts prohibited

(a) A person may not knowingly, for valuable consideration, purchase or sell a part for transplantation or therapy, if removal of the part is intended to occur after the death of the decedent.

(b) For purposes of this section, valuable consideration does not include reasonable payment for the removal, processing, disposal, preservation, quality control, storage, transportation, implantation and related research costs incurred by procurement organizations.

(c) A person who violates this section shall be fined not more than $50,000.00 or imprisoned not more than five years, or both. (Added 1989, No. 273 (Adj. Sess.), § 9, eff. June 21, 1990.)
